Acceptable use policy

This policy forms part of the Terms of Service. It covers what your organization may send us, and how our research may be used. It exists because the services are built on a narrow data boundary, and that boundary only holds if both sides respect it.

What you promise about the data you send us

By sending us Customer Data, your organization confirms that:

  • It has the right to provide that data to us and to have us process it as described in the privacy policy.
  • Doing so does not breach any law, any contract, or any notice or consent your organization gave to the individuals concerned.
  • The data contains none of the categories listed below, and your organization has reviewed its export before sending it.

Data you must not send us

Do not upload, enter, or otherwise provide any of the following. If you are not certain whether a field or a list falls into one of these categories, ask us at support@benefactorintelligence.com before sending it.

  • Protected health information, or any data derived from it. This includes patient status, any indication that a person is or was a patient, diagnoses, treatment, clinical records, electronic health record fields, dates or department of service, treating physician, and insurance status. It also includes a prospect list assembled from a grateful patient program, or any other list where inclusion itself implies a person received care. We are not a HIPAA business associate, we have no business associate agreement with you, and we are not built to receive this data.
  • Student education records governed by FERPA, including grades, enrollment records, disciplinary records, and financial aid records. Alumni and donor records that carry no education-record content are outside this restriction.
  • Special categories of personal data, meaning information revealing racial or ethnic origin, political opinions, religious or philosophical beliefs, trade union membership, genetic or biometric data, health, sex life, or sexual orientation.
  • Government identifiers and financial account details, including Social Security numbers, passport and driver’s license numbers, bank account numbers, and payment card numbers. We never need these.
  • Data obtained from a security breach, a data broker, or a scraped private network, or any data obtained in breach of another party’s terms of service.
  • Information about anyone under 18.

If you discover that restricted data has reached us, tell us at support@benefactorintelligence.com and we will delete it and confirm in writing.

How our research may not be used

Our output supports fundraising and advancement work. It is not a consumer report and we are not a consumer reporting agency under the Fair Credit Reporting Act. You must not use our output, in whole or in part, as a factor in any decision about:

  • Employment, including hiring, retention, promotion, or reassignment.
  • Credit or lending.
  • Insurance underwriting or pricing.
  • Housing or tenancy.
  • Eligibility for a government license or benefit.

You must also not:

  • Publish our output, or resell it, license it, or provide it to a third party as a research service.
  • Use it to harass, intimidate, stalk, or discriminate against anyone, or in a way that would be unlawful.
  • Present an unverified claim as established fact. Every claim links to its source; check it before you act on it or repeat it.

Use of the application

Do not:

  • Attempt to access another organization’s data, probe our access controls, or circumvent any usage limit.
  • Scrape the application, or use automated means to extract data beyond the features we provide.
  • Share credentials, or give access to anyone outside your organization.
  • Interfere with the operation of the services or the infrastructure behind them.
  • Upload malware, or anything designed to disrupt or gain unauthorized access.

Enforcement

Where we believe this policy has been breached we may remove the data concerned, suspend the account, or terminate it. Where the circumstances allow, we will tell you first and give you a chance to fix the problem. A breach that puts restricted data in our systems, or that exposes another customer, may require us to act immediately.

A prohibition in this policy is not a substitute for your own review. If your organization knows that data it plans to send falls into a restricted category, tell us before sending it rather than relying on this policy to cover it.
